If a bill establishing data center power-cost standards has become law after Issuance and before Jan 1, 2027, then the market resolves to Yes.

The provision may appear in any legislative vehicle. It must establish a standard for data-center customers with aggregate peak demand of at least 100 megawatts at one site or campus: recovery from the customer of full incremental generation, transmission, or distribution upgrade costs, including after contract termination, plus financial assurances or contributions before upgrades. The Ratepayer Protection Act's PURPA mechanism requiring state regulators and nonregulated utilities to consider this standard qualifies; state adoption is not required. A substantively equivalent mandatory federal standard also qualifies. Committee action or passage by only one chamber does not constitute becoming law.
